Recognition MOU
The parties agree to the following method for dealing with the issue of non-bargaining unit personnel performing bargaining unit work. A joint committee shall be established consisting of two members of the faculty selected by the Union and two non-faculty personnel selected by the University. During the 2008-2009 AY, the committee shall meet to address and resolve matters relating to the current practice of having no-bargaining unit personnel performing bargaining unit work. The committee shall meet as frequently as necessary and shall be provided with all relevant data and information necessary to make a decision both in the best interest of the University and for the integrity of the bargaining unit.
The parties recognize that the current practice may continue until resolution of the issues is reached.
Should and issues remain unresolved at the end of the 2008-2009 AY the Union reserves any rights it may have to place those remaining issues before PERC.
